Abstract
This comment describes the use of consumer credit checks to evaluate job candidates. H.R. 3149 (the “Equal Employment for All” Act), introduced to Congress in July 2009, which proposed to amend the Fair Credit Reporting Act (“FCRA”) to prohibit this practice. It provides an excellent starting point for addressing employee and job applicant privacy concerns.
